Planning permission for the dwelling was granted by North Wiltshire District Council on 5th September 1977 (under ref. N.77.0482.F), subject to the following agricultural occupancy condition;
1. The occupation of the dwelling shall be limited to a person solely or mainly employed, or last employed, in the locality in agriculture as defined in Section 290(I) of the Town and Country Planning Act, 1971, or in forestry, (including any dependents of such a person residing with him or her) or a widow or widower of such a person.
Reason: The site is in an area within which it is the policy of the local planning authority to limit development to that which is essential for agricultural or forestry purposes.
North Wiltshire District Council issued an Enforcement Notice on 23rd October 2003 (ref. 03/00038/EMAJ) concerning the breach of the condition by the previous owner. At the same time, a planning application was submitted, seeking the removal of the condition (LPA ref. 03/01223/S73A).
Appeals against the Enforcement Notice and the refusal of the application to remove the condition were dismissed and the Enforcement Notice upheld on 4th May 2004. On that basis, the Enforcement Notice came into effect on 4th February 2005. The Enforcement Notice remains in place today.
Prospective purchasers will be invited to produce evidence that they are able to satisfy the requirements of the occupancy condition as set out above. From Malmesbury take the A429 to Chippenham. After driving through Corston and under Kingway Railway Bridge, take the second exit at the first roundabout and then follow the signs for Hullavington. At the crossroads at the top of the village do not turn left into the village, but carry on straight, then around a sharp right-hand bend and under the railway bridge. Follow the road for about 250 metres and at the top of a slight rise in the road you will see the entrance to Bradfield Bungalow on the right.
